When the Marina View Body Corporate Committee looks back over the past decade, it’s hard to believe how much ground has been covered. What began as a complex facing significant building issues in Gisborne became a long, demanding process of remediation, legal navigation, financial decision-making, and rebuilding trust and confidence among owners.
This wasn’t a simple remediation project, nor was it something any one party could have managed alone. Progress came through steady collaboration between committed owners, a highly involved committee, specialist consultants, contractors, legal advisers, and professional body corporate management.
The Marina View story is ultimately one of persistence, shared responsibility, and teamwork — and of a complex that has come through an extraordinarily challenging period to reach a position of stability and compliance.
A Journey Years in the Making
Formal investigations into leaks and defects began around 2015, setting Marina View on a path that would stretch over a decade. Key milestones included:
- Mediation with Council in 2018
- A High Court–sealed Section 74 scheme later that year
- A major construction contract commencing in 2022
- Staged reoccupation from late 2024
- Code of Compliance issued in April 2025
- Final loan repayment completed in October 2025
On paper, these milestones look neat and sequential. In reality, the process involved years of uncertainty, difficult conversations, and complex decisions — all requiring careful coordination and a long-term view from those involved.
Bringing in Professional Support
As the scale of the challenge became clear, the Committee recognised the need for experienced external body corporate management. After an initial attempt with a lower-cost provider proved unsuitable, the Committee appointed apm on the recommendation of a long-serving member.
That decision provided continuity and structure during a period when both were in short supply.
In the Chair’s report, this support was acknowledged clearly:
“Jessica and her team at Auckland Property Management have been a huge support. Their experience dealing with body corporates, and their financial management, kept us compliant with our legal requirements throughout a very complex process.”
apm worked alongside the committee, supporting governance, financial administration, and compliance as the project moved through multiple unfamiliar stages.
Navigating Legal, Financial, and Operational Complexity
The Marina View remediation presented challenges that were uncommon for most body corporates at the time.
Legal action and claims
Marina View became the first apm-managed body corporate to pursue legal action against multiple parties in relation to building defects. This required close coordination with legal advisers, tax and technical consultants.
Funding a major remediation
As remediation plans were confirmed, securing appropriate funding became critical. The Committee, supported by apm, worked through the complexities of one of New Zealand’s early body corporate loans with an Australian lender. Clear communication with owners and careful compliance management were essential throughout this process.
Managing finances under pressure
Day-to-day financial administration during remediation was demanding. Arrears, payment plans, and sensitive debtor situations required persistence and diplomacy. apm’s Body Corporate team worked closely with the committee to keep finances transparent and moving, even when conversations were challenging.
Responding to a distressed unit
In a rare situation, the Body Corporate established a limited liability company to purchase a unit after the owner defaulted and entered liquidation. This was a legally sensitive process, and one that required careful guidance and collective decision-making.
A Strong Committee at the Centre
While professional support was important, the project’s success rested heavily on the dedication of Marina View’s Committee and key individuals who went well beyond what is typically expected.
Alongside these individuals, consultants, architects, and contractors all contributed specialist expertise. The Committee’s leadership and willingness to stay engaged over many years was central to holding the project together.
What Made the Difference
Throughout the correspondence and final reporting, one theme stands out: the importance of experience, calm decision-making, and people working well together under pressure.
As Jessica from apm reflected:
“There were many ‘firsts’ throughout this process. The strength of the committee and the wider team made it possible to work through them. It really was a collective effort.”
APM’s role was to provide structure, guidance, and continuity — helping the committee understand options, meet legislative requirements, and move forward step by step, even when the path wasn’t always clear.
Looking Ahead
When the Code of Compliance was issued in April 2025 and owners were able to fully reoccupy the building, it marked a significant turning point. Completing the final loan repayment later that year was another milestone many had once thought unlikely.
In closing, the Chair summed up the experience:
“Working with Jessica and the apm team has been a positive experience throughout a very demanding time. Appointing apm was one of the better decisions we made.”
Today, Marina View stands as a complex that has come through adversity with renewed stability and confidence. Its story reflects what can be achieved when committed owners, a strong committee, and experienced advisers work together over the long term — even when the journey is anything but straightforward.
